Terms
The terms we work under.
Effective September 10, 2026
These terms apply to your use of midnightdrive.co and to the services Midnight Drive provides. By using this site or engaging us, you agree to them. Where a signed service agreement exists between Midnight Drive and a client, the service agreement governs if the two conflict.
Who we are
Midnight Drive is a marketing and sales agency operated by Grow Against Limits, based in Toronto, Ontario, Canada. We work with auto detailers, paint protection film installers, and window tint shops.
Using this website
You may browse this site and use the contact form to get in touch about our services. You agree not to misuse the site, attempt to gain unauthorized access to it, submit false or misleading information through the form, or use automated tools to scrape or overload it. The content of this site, including copy, design, and images, belongs to Midnight Drive or its licensors and may not be reproduced without permission.
Services
The scope, pricing, and term of our services are set out in a written service agreement with each client. Marketing results depend on many factors outside our control, including market conditions, platform changes, and how a client handles the leads we generate. We do not guarantee specific outcomes, rankings, lead counts, or revenue.
Client accounts and access
Clients who grant us access to advertising, analytics, or business accounts remain the owners of those accounts and the data in them. We use that access only to deliver the agreed services and we remove our access when the engagement ends, or sooner if the client asks. Clients are responsible for keeping their own credentials secure and for the accuracy of the business information they give us.
Google services
Some of our work uses Google products, including Google Ads and the Google Ads API. Clients who connect a Google Ads account to our manager account agree to the applicable Google terms for those products. Our handling of data from Google APIs is described in our Privacy Policy.
Payment
Fees, billing cycles, and payment terms are set in the service agreement. Advertising spend paid directly to platforms is separate from our fees unless the agreement says otherwise. Late payments may result in paused services.
Ownership of work
Unless the service agreement says otherwise, landing pages, creative, and copy we produce for a client become the client's property once paid for in full. Our internal tools, templates, processes, and know-how remain ours. We may describe work we have done in our portfolio without disclosing confidential client information.
Confidentiality
We treat client business information, performance data, and customer lists as confidential and use them only to provide our services. Clients agree to treat our pricing, methods, and internal materials as confidential in the same way.
Limitation of liability
To the extent permitted by law, Midnight Drive is not liable for indirect, incidental, or consequential losses, including lost profits or lost business, arising from use of this site or our services. Our total liability for any claim is limited to the fees the client paid us in the three months before the claim arose.
Ending an engagement
Either party may end an engagement as described in the service agreement. On termination we hand over completed work the client has paid for, remove our access to client accounts, and stop processing client data except as needed to meet legal obligations.
Governing law
These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there. Any dispute will be handled in the courts of Ontario, unless the service agreement says otherwise.
Changes
We may update these terms from time to time. The effective date at the top of the page tells you when they were last changed. Continued use of the site after a change means you accept the new terms.
